An educational employee who is a member of a collective agreement unit may be disciplined by a reprimand, suspension or other means for whatever reason that would constitute grounds for dismissal under the existing collective agreement or which is mentioned above. An educational employee who is not a member of a collective agreement unit may be disciplined by reprimanding, suspending or otherwise discrediting, for some reason set out in this policy. While the agreement with the teachers` union gives teachers a raise, Florida is still leading the nation for teachers` compensation. Any member of the teaching staff who is suspended or dismissed has the opportunity to appeal the legal action. The procedure for teaching workers whose position is occupied is the process provided for by the collective agreement, including the appeal procedures provided for. Educational assistance staff who are not employed in a management or confidentiality position may challenge their suspension or termination as part of the appeal procedure described in The Board of Directors 4470. In the event that a member of the teaching staff is dissatisfied with the outcome of the appeal procedure, the staff member may request an administrative hearing in accordance with Chapter 120 of the F.S. Any request for an administrative hearing must be filed within 10 days of receiving the Level 3 employee`s refusal. Staff members in executive or confidentiality positions may request a review of their suspension or termination as part of the Board Policy 4470 appeal procedure. The board`s decision on any confidential or management position is final. All teaching support staff are used on trial for the period set out in an applicable collective agreement or, in the absence of an applicable collective agreement, for the period set by the current board rule. Any teaching staff whose position is not the subject of a collective agreement, with the exception of those in a management or confidentiality position, may be terminated for one or more of the following reasons: the agreement provides for increases for new and existing teachers, but the agreement is made because teachers are taught and administrative jobs are eliminated throughout the county.
