„Documentation“: user manuals and other end-user documents for the corresponding service, available on the service`s online support function and updated from time to time by Octa, including, without limitation, the material available under www.support.okta.com and the „Trust and Compliance“ documentation available under www.okta.com/trustandcompliance. 9.1 Octa Compensation Obligation. Subject to dial 9.3, Okta will defend the customer against all claims, claims, actions or proceedings filed by a third party against the customer who asserts that the service or professional services as made available to the customer by Okta under this agreement infringe patents, copyrights or trademarks or abuse third-party business secrets (a „counterfeit claim“). Octa releases the client for any damages and/or costs (including, but not limited, reasonable legal fees) awarded by a competent court or paid to a third party under a settlement agreement signed by Octa in connection with an infringement claim. In the case of such a right of infringement, Octa may obtain a licence of its choice to allow the customer to continue to use the service; (ii) to modify or replace the affected parties of the service with an alternative that is not contrary to the law which, within a reasonable period of time, will have a substantially equivalent benefit, or (iii) to terminate the injury service contract and reimburse the customer for any unused costs paid in advance for such an invivant service. Notwithstanding the above, Octa disclaims any liability for any infringement claim of any kind, as long as it results from the following reasons: 1) changes in service made by a party other than octa; (2) the combination of service with other products, processes or technologies (if the infringement had been avoided for such a combination); or (3) the customer`s use of the service, except in accordance with the documentation and this contract. The compensation obligations covered in this section 9.1 are Okta`s exclusive and exclusive obligations, as well as the client`s exclusive and exclusive remedies in the event of a violation or misappropriation of third party intellectual property rights of any kind.
