The programs listed in the LOI are licensed under these terms, in addition to the program license prerequisites agreed to by customer and IBM. If the customer has not previously accepted the license terms applicable to the program, either the international program license agreement or the international license agreement applies to the unsecured programs, as set out in the LOI. Unless Hearne warrants otherwise in writing, Licensee acknowledges that licensee must rely on its own judgment about the nature, quality and condition of the IBM SPSS software provided by Hearne and its suitability for any use or purpose, and Licensee acknowledges that Hearne is under no obligation to verify the suitability of the IBM SPSS software it has licensed, for any purpose, and that such a representation was made by Hearne. This license grants Licensee the rights (a) to use the IBM SPSS software indicated in the invoice and/or online order for the number of users or uses authorized and/or as set forth in IBM`s license material; (b) If you have the right to obtain upgrades to the IBM SPSS software as well as any support from Hearne, as set forth in Hearne`s invoice and/or online order confirmation; and (c) otherwise use Hearne`s IBM SPSS licensed software in accordance with this license. Its copy of SPSS has been successfully installed and licensed Licensee acknowledges that it is not a licensee of IBM and that all rights and remedies of Licensee with respect to the provision of IBM SPSS Software are in the hands of Hearne, as set forth in this License. IBM grants Licensee the right of an authorized end user to use the Software at the location specified in the schedule.
